These terms are an agreement between you and Gary Vogt Consulting, a sole proprietorship in Orangevale, California, doing business as RevivedLocal ("RevivedLocal", "we", "us"). They cover revivedlocal.com, the customer portal at app.revivedlocal.com, and everything we sell. By buying from us, signing in to the portal, or using our services, you agree to these terms and to our Privacy Policy. If you agree on behalf of a business, you confirm you have the authority to do so.
If we give you a written quote for custom work, the quote's terms apply to that work alongside these terms. Where the two differ, the quote wins.
Prices are in US dollars. The price shown at checkout, or in your written quote, is the price you pay. Annual prepay, where we offer it, gets two months free.
We promise to do the work described for your plan with care, to measure honestly, and to tell you what we found, including when the answer is that we could not check something.
We cannot promise results that other companies control. AI assistants, Google and directory sites decide for themselves what to show, and they change without notice. The AI Visibility Monitor reports what the assistants said on the day we asked, and asking again can get a different answer. A page we could not read is reported as unknown, not as a problem. We do not guarantee any ranking, traffic, calls, sales, or a place in any AI answer.
Payments are processed by Stripe. We never see or store your full card number.
Automatic renewal. Monthly plans renew automatically each month and are charged to the card you used at checkout, at the price you signed up for, until you cancel. Annual prepaid plans renew each year on the same terms. You can cancel at any time as described in section 6.
You can cancel any monthly plan at any time by emailing info@revivedlocal.com from the address on your account, or by calling 916-999-5460. We will confirm the cancellation by email. Your plan stays active until the end of the period you have already paid for, and you will not be charged again. Your customer portal history stays readable after you cancel.
We may also refund outside these rules when it is the right thing to do, such as a billing mistake. Refunds go back to the card you paid with. Ask at info@revivedlocal.com.
The text, photos, logos and other content on your website belong to you, including what we write for you once it is paid for. The templates, code and tools we use to build and run the site remain ours, and we license them to you for as long as you are on a website plan. Your $50 monthly plan covers hosting and the monthly Google Analytics report. If you end it, we will send you your site's content so you can take it elsewhere.
You keep ownership of your business information, your content and your data. You give us permission to use them only to provide our services to you, including publishing what you approve on your website, listings and social accounts. We do not use your content to train AI models.
The AI Visibility Monitor, our SEO Crew agents, our templates, the customer portal, and the methods and software behind them belong to us. If you send us suggestions, we may use them without owing you anything.
We will not name your business publicly as a customer, or publish your results as a case study, without your permission.
Portal accounts are by invitation. Anyone you invite to your business's portal can see what you can see, so invite only people you trust. We may view your account to support you, and the portal keeps a record when we do.
Your Monitor is published at a private web address. We do not link to it or list it for search engines, but anyone you give the link to can open it. Ask us and we will take it down.
Please do not use our services to break the law, to misrepresent a business, to harm or harass anyone, to copy or resell our services or the Monitor's results without our written permission, to scrape or overload our sites, or to get into accounts or data that are not yours. We may suspend service if you do.
Our work depends on other companies, including Google, the AI assistants, directory sites, Stripe and our hosting providers. Their own terms apply to your use of them. We are not responsible for what they do, including changes to their answers, rankings or listings, or a suspension of an account they run.
Except for the promises in these terms, our services are provided as they are and as available. To the extent the law allows, we disclaim all other warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and any warranty that our services will be uninterrupted, error free, or that any result will be achieved.
To the extent the law allows, we are not liable for lost profits, lost revenue, lost data, or any indirect, incidental, special or consequential damages. Our total liability for any claim relating to our services is limited to what you paid us in the 12 months before the claim arose.
Some places do not allow some of these limits, so they may not all apply to you.
If someone makes a claim against us because of content or information you gave us, content you approved, your breach of these terms, or your breaking the law, you agree to cover our reasonable costs of dealing with it, including legal fees.
You can stop at any time by cancelling. We can end or suspend service if you do not pay, if you break these terms, or if we stop offering a service, in which case we will give you reasonable notice and refund any period you paid for and did not receive. Sections 7, 9, 14, 15, 16 and 18 continue after service ends.
If something goes wrong, contact us first at info@revivedlocal.com, and we will try to put it right within 30 days. These terms are governed by the laws of the State of California. Any dispute we cannot resolve together will be decided in the state or federal courts for Sacramento County, California, and you and we agree to those courts' jurisdiction.
We may update these terms. When we do, we change the date at the top, and for changes that matter we email our customers before they take effect. If you keep using our services after that, the new terms apply. If you do not agree, you can cancel.
These terms, your quote if you have one, and our Privacy Policy are the whole agreement between us about our services. If part of these terms cannot be enforced, the rest still applies. If we do not enforce something straight away, we have not given up the right to. You may not transfer this agreement without our permission. We may transfer it to a buyer of RevivedLocal, who will be bound by it.
